1. Acceptance of Terms

By accessing or using CrewFinder ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service. These Terms constitute a legally binding agreement between you and CrewFinder.

2. Description of Service

CrewFinder is a marketplace platform that connects outdoor trade businesses with skilled workers, specializing in tree service, landscaping, hardscaping, and irrigation. We provide tools for job discovery, professional profiles, messaging, voice calling, crew scheduling, storm response coordination, and equipment listing.

CrewFinder is not an employer, staffing agency, or labor broker. All employment relationships, compensation, insurance, safety compliance, and tax obligations are between the business and worker directly.

3. User Accounts and Responsibilities

• You must be at least 18 years old to create an account
• You must provide accurate and current information
• You are responsible for maintaining the security of your account credentials
• You are responsible for all activity under your account
• You must promptly notify us of any unauthorized use of your account
• One person or entity may not maintain multiple accounts

4. Prohibited Conduct

You agree not to:

• Post misleading or fraudulent listings — fake jobs, inflated qualifications, or deceptive profiles
• Harass, threaten, or discriminate against other users
• Scrape, crawl, or data mine the platform or its content
• Circumvent platform safety measures, rate limits, or access controls
• Spam other users with unsolicited messages
• Impersonate another person or entity
• Upload malicious content including viruses or harmful code
• Use the platform for any illegal purpose
• Share or solicit personal information outside the platform to circumvent fees

5. Payment Terms and Membership

For Workers

CrewFinder is free for workers. There are no fees to create a profile, browse jobs, or receive messages.

For Businesses

Business accounts require a paid subscription to access premium features including unlimited messaging, the caller portal, priority listing, and crew management tools. Subscription plans are:

• Monthly plan: Billed monthly, cancel anytime
• Annual plan: Billed annually at a discounted rate

Payments are processed securely through Stripe. By subscribing, you authorize recurring charges to your payment method. You can manage your subscription, update payment methods, or cancel at any time through the Subscription Management portal.

Free Tier

Business accounts without a subscription can browse worker profiles and post basic listings but have limited access to messaging and premium features.

6. Cancellation and Refund Policy

• You may cancel your subscription at any time through the app
• Cancellation takes effect at the end of your current billing period
• You will retain access to paid features until the end of your current billing period
• No refunds for partial billing periods
• If you believe you were charged in error, contact us within 30 days for review

7. Intellectual Property

The CrewFinder name, logo, design, and all platform software are the intellectual property of CrewFinder. You may not copy, modify, distribute, or reverse-engineer any part of the Service without written permission.

8. User-Generated Content

You retain ownership of content you post on CrewFinder (photos, descriptions, reviews, messages). By posting content, you grant CrewFinder a non-exclusive, worldwide, royalty-free license to use, display, and distribute that content on the platform and in promotional materials related to the Service.

You represent that you have the right to share any content you upload and that it does not infringe on the intellectual property rights of any third party.

9. Ratings and Reviews

Ratings and reviews must reflect honest, firsthand experiences. We reserve the right to remove reviews that are fraudulent, retaliatory, contain hate speech, or violate these Terms. Both workers and businesses can rate each other after completing work.

10. Limitation of Liability

CrewFinder is provided "AS IS" and "AS AVAILABLE" without warranties of any kind, express or implied. To the maximum extent permitted by law:

• We do not guarantee the quality, reliability, or accuracy of any worker, business, or listing on the platform
• We are not responsible for disputes, workplace injuries, property damage, or losses arising from connections made through CrewFinder
• Our total liability to you shall not exceed the amount you paid to us in the 12 months preceding the claim
• We are not liable for any indirect, incidental, special, consequential, or punitive damages

11. Indemnification

You agree to indemnify, defend, and hold harmless CrewFinder, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising out of or related to your use of the Service, violation of these Terms, or infringement of any third-party rights.

12. Dispute Resolution

Any dispute arising from or relating to these Terms or the Service shall be resolved through binding arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules. Arbitration shall take place in Massachusetts. You agree to waive any right to a jury trial or to participate in a class action lawsuit.

For claims under $10,000, either party may elect small claims court instead of arbitration.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Commonwealth of Massachusetts, without regard to its conflict of law principles.

14. Modification of Terms

We may update these Terms from time to time. We will notify you of material changes by posting the updated Terms on this page with a new "Last updated" date. Continued use of CrewFinder after changes constitutes acceptance of the updated Terms. If you do not agree to the updated Terms, you must stop using the Service.

15. Termination

We may suspend or terminate your account at any time if you violate these Terms or engage in conduct that is harmful to the platform or its users. You may delete your account at any time through the app settings. Upon termination, your right to use the Service ceases immediately, though certain provisions of these Terms will survive termination.
